From what we know of the movie timeline, this takes place after Obi-wan and Yoda watch Anikan sweep thru the Jedi temple and pledge himself to Sideous. At this point, in my mind, Anikan is no longer a Jedi and Obi-wan attempting to kill him is perfectly acceptable.
It is perfectly alright to kill him, just as it would have been for Mace to kill Palps or for Yoda to kill Palps. But he doesn't kill Vader, though I wonder if at the end of ROTS he believes he may have.
I am not sure where murder and the Jedi Code come in. Was he supposed to comtemplate finishing Vader off? And given Vader's predicament, it probably didn't seem necessary.
But, what could Kenobi have done? How far is Vader from him? Vader's robe is catching fire, he is barely holdling his ground in the sand with his one arm, and he then catches on fire. Then here comes a shuttle. So, leaving him there for dead is not murder.
